What is the Beckham Law?

The Spanish tax regime can be quite demanding, as regular tax residents are required to pay taxes on their worldwide income, with rates reaching up to 47%–52%, and may also be subject to wealth tax on their global assets.

Fortunately, Spain offers a favorable alternative: the Special Expatriate Tax Regime, commonly known as the Beckham Law, aimed at attracting foreign talent and investment.

Under this regime, qualifying individuals are only taxed on:

  • Spanish-source income, and
  • Employment income, even if earned abroad.

All other foreign-sourced income such as dividends, interest, capital gains or rental income is not subject to Spanish taxation and does not need to be declared.

What are the main advantages of this law?

The Beckham Law, named after footballer David Beckham, who was among the first to benefit from it, offers several tax benefits:

  • Flat 24% tax rate on employment income up to €600,000.

  • Flat 47% tax rate on employment income exceeding €600,000.

  • No obligation to declare foreign assets (exemption from Modelo 720).

  • No taxation on foreign capital income, such as dividends, interest, capital gains, or foreign rental income.

  • You are taxed as a non-resident for income and wealth tax purposes for up to six consecutive tax years.

  • Family members (spouse and dependent children) may also opt in under favorable conditions.

Note: You may still be subject to Wealth Tax in Spain if your Spanish-sited assets exceed the applicable exemption in your region.

Who can benefit from it?

The Beckham Law applies to individuals becoming tax residents in Spain, provided that:

· They have not been tax residents in Spain during the previous 5 tax years, and

· They relocate to Spain as a result of:

  • A local employment contract in Spain, or relocation by a foreign employer.

  • Appointment as company director, regardless of shareholding, unless the company qualifies as a holding company (entidad patrimonial).

  • Launching a certified entrepreneurial activity, as validated by ENISA.

  • Providing services as a highly qualified professional in sectors such as R&D, technology, or education, particularly in connection with startups.

* Self-employed individuals (Autónomos) are excluded, unless they fall within one of these very limited categories (e.g., innovative entrepreneurs or service providers to startups). Freelancers in general are not eligible.

Extension to family members

A key update introduced by the 2022 reform allows certain family members of the main applicant to also benefit from the regime. This includes:

  • Spouse or registered domestic partner, and
  • Children under 25 (or older if disabled), economically dependent on the main applicant.

Conditions for family members:

  • They must not have been tax residents in Spain during the last 5 tax years.

  • They do not need to work to qualify under the regime.

  • If they do earn income, it must be employment income only.
*Self-employment or professional income is not allowed.

  • Their annual income must not exceed €600,000.

  • They must apply within six months from registering in Spain.

Each family member must apply individually, but once accepted, will enjoy the same tax treatment as the main applicant.

About the Beckham Tax Regimel in Spain

The Beckham Law, officially known as the Special Expatriate Tax Regime, is a tax incentive introduced in Spain that allows foreign workers relocating to Spain to pay a flat tax rate of 24% on their Spanish-sourced income for up to six years, instead of the progressive tax rates applicable to Spanish tax residents. It was originally designed to attract top talent and foreign workers to Spain. workers to Spain.

To qualify for the Beckham Law, the following conditions must be met:

  • The individual must not have been a tax resident in Spain for the 5 years prior to the application.

  • The movement to Spain must be due to:

    Spain (i.e., self-employed business).

The Beckham Law applies for a period of six years, since the first year of the tax residency status acquisition, which can include, or not, the year of arrival in Spain.

Under the Beckham Law, eligible individuals pay a flat 24% tax rate on income earned in Spain, up to €600,000. Any income exceeding €600,000 is taxed at 47%. Non-Spanish sourced income, such as foreign investments or property, is not subject to Spanish taxation under this regime, although this may change depending on certain circumstances.

No, professional athletes are no longer eligible for the Beckham Law. This change was made in 2015 following controversy around its use by high-profile athletes, including football players.

The Beckham Law applies only to Spanish source income with the exception of employment income which would be taxed on a worldwide basis and, in its case, it would be possible to apply a tax credit if taxation on a third country arises regarding such employment income.

To apply for the Beckham Law, you must submit a formal request to the Spanish tax authorities (Agencia Tributaria) within six months of registering for Social Security in Spain. The process requires submitting Form 149, and you may need assistance from a tax professional to ensure that the application is correctly completed.

Yes, you can lose eligibility for the Beckham Law if you:

  • Leave Spain or cease employment in Spain.
  • Fail to comply with Spanish tax regulations.
  • Exceed certain income thresholds for activities not related to your employment contract.

Under the Beckham Law, only your Spanish-sourced income is subject to Spanish taxes. However, depending on your home country’s tax regulations, you may still be liable for taxes in your country of origin. Consulting a tax advisor is recommended to manage international tax obligations effectively.

No, the Beckham Law cannot be renewed after the six-year period. Once the regime ends, you will be taxed as a regular resident in Spain, subject to the progressive tax rates on worldwide income.

We can't thank Alex, Agustina, and Sofia enough for all their help obtaining our visas and our apartment. The entire process was daunting, but they walked us through step-by-step. We had a lot of questions but they were so incredibly kind and patient. ¡Muchas gracias!

I am now a spanish resident on the digital nomad visa thanks to Vera, Carolina and Pilar from Carbray. Vera and Carolina were incredibly supportive in helping me get together the documents I needed, meticulously spotting missing signatures and communicating clearly throughout the entire process. Pilar supported with my successful application for Beckham's law. Due to a misunderstanding in how long I had to apply, she took this on very last minute and even spoke on the phone spanish officials at one of my appointments to make it happen in time. I would definitely recommend. Thanks all 🧡

Carbray International has been extremely helpful in helping us obtain residency in Spain and getting our Spanish passports. The process would have been much more difficult (and possibly impossible) without their guidance. We cannot thank them enough for their guidance and patience throughout the process. I highly recommend partnering with them and tapping into their services. A special thank you and shout out to Alex Parfen and Sofia Grondona of the Carbray International team!
